Terms of Service BETA

SmilePom is currently in beta. By using the app you agree to these terms. We'll update them before the public launch — you'll be notified of any significant changes.

1. Acceptance of Terms

By creating an account or using SmilePom ("the app"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the app.

2. Who Can Use SmilePom

You must be at least 13 years old (16 in the EU) to use SmilePom. By using the app, you confirm you meet this requirement. The app is intended for personal productivity use.

3. Your Account

You are responsible for keeping your account credentials secure
You are responsible for all activity that occurs under your account
You must provide accurate information when creating your account
You may not share your account with others or create accounts on behalf of others

4. Acceptable Use

You agree not to:

Use the app for any unlawful purpose
Attempt to reverse engineer, decompile, or extract source code from the app
Attempt to gain unauthorised access to other users' data or our systems
Use the app in a way that disrupts or damages its functionality
Scrape, copy, or redistribute app content without permission

5. Beta Programme

SmilePom is currently in beta testing. This means:

Features may change, be removed, or behave unexpectedly
The app may experience downtime or data loss
We may contact you for feedback to help improve the app
Beta access is provided free of charge and may be revoked at any time

We recommend not using SmilePom as your sole record of critical task or calendar data during beta.

6. AI Features

SmilePom uses Google Gemini to provide scheduling suggestions, coaching, and personalisation. AI-generated advice is for informational purposes only. We do not guarantee its accuracy and it should not be relied upon for medical, legal, or financial decisions.

7. Your Content

You own the data you create in SmilePom (tasks, sessions, notes, events). By using the app you grant us a limited licence to store and process that data solely to provide the service to you. We do not use your personal content to train AI models.

8. Subscription and Payments

SmilePom will offer free and paid tiers. Pricing, billing terms, and refund policy will be published before any paid features are introduced. During beta, all features are available free of charge.

9. Availability and Changes

We aim to keep SmilePom available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the app at any time with reasonable notice where possible.

10. Disclaimer of Warranties

SmilePom is provided "as is" without warranties of any kind, express or implied. We do not warrant that the app will be error-free, uninterrupted, or meet your specific requirements.

11. Limitation of Liability

To the fullest extent permitted by law, SmilePom and its developers shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app, including loss of data or productivity.

12. Termination

You may delete your account at any time via Settings → Account → Delete Account. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

13. Governing Law

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict of law provisions. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, Florida.

14. Changes to These Terms

We may update these terms as the app evolves. We will notify you of significant changes via email or an in-app notice at least 14 days before they take effect. Continued use of the app after that date constitutes acceptance of the updated terms.
